Welcome to History Imprint web site.

The following Terms of Service ("TOS") contain the terms and conditions that govern your (also referred as User) use of the Web Site and History Imprint Service. Use of the Prints constitutes acceptance of these TOS.

History Imprint reserves the right to add, delete and/or modify any of the terms and conditions contained in this TOS, at any time and in its sole discretion, by posting a change notice or a new agreement on the History Imprint Web Site.

This TOS constitutes the entire and only agreement between us and you(user), and supersedes all prior or contemporaneous agreements, representations, warranties and understandings.

History Imprint uses other affiliated companies or third parties to provide certain products and services accessible through the Web Site.History Imprint does not control those third parties or their services. Users agree that History Imprint will not be liable to you in any way for your use of such services as our affiliates or third parties may have their own Terms and Conditions. In case of conflicts between Terms and Conditions, you must comply with History Imprint’s TOS.

Eligibility to use Website:

History Imprint will only knowingly provide service to a customer that can lawfully enter into and form contract under applicable law. If site user is under age of 18, but at least 13 years of age, he/she may use the History Imprint services under supervision of parent or legal guardian after they agree to these TOS. History Imprint website is not intended for children under age of 13.

Historyimprint.net grants users limited revocable license to access and use the website for its offered services, subject to users’ compliance with these TOS. History Imprint does not allow customers to collect or use information collected on the website to compete with History Imprint or to create derivative work based on the content of the web site. If user uses the information other than per TOS, History Imprint may revoke the access and pursue other legal course of action permitted under applicable state or federal law.

Prohibited Use:

User can only use the website as expressly permitted by History Imprint User may not cause harm to the website. Specifically, but not by way of limitation, user may not:

Interfere with website performance by using viruses or any other technology or program designed to affect performance, content, and appearance of the website.
Modify, create derivative works from reverse engineer, decompile or disassemble any technology.
Collect any user information used for registration

All the content including but not limited to: Design, graphics, organization and digital conversion related to site are protected under applicable copyright, trademarks and other property rights. Copying, downloading or redistribution of any such matters or any part of site, except outlined in this TOS, is strictly prohibited.

User will retain ownership of the content that are used, referred or uploaded by the user during the use of the site. "While using any outside content, user grants following licenses to History Imprint, the non-exclusive, worldwide, transferable, sublicensable right to copy, crop, reproduce, publicly display, sell and distribute design in or on products and in advertising, marketing, samples, and promotional materials for History Imprint.” And the right to make modifications to users' design. We will not distribute it without prior approval from your side.

User may remove the design, graphics or file, designed or uploaded by the user, at any time during the usage of the website.

You may remove the Content you sent for design at any time, and you retain any copyright and other intellectual property rights in that Content. If you choose to remove Content that you designed or uploaded and notify History Imprint of your intention to terminate the licenses described in the above paragraph, those licenses will terminate, except that History Imprint may fulfill all orders that are in any way derived from that content placed prior to notice of termination and may continue to use said content in marketing and promotional materials.

If user believes that her/his work has been copied in a way that constitutes copyright infringement, please provide our copyright agent (david@historyimprint.net) following information.

a. Written document with signature of the person authorized to act on behalf of the owner of the copyright interest.
b. Detail on material that is claimed as infringed
c. Contract information.

Our Agent will quickly act on any such notice received.

Reservation of Rights:

History Imprint reserves the right but does not assume the obligation to monitor transactions and communications occurs through website. If History Imprint determines, in its sole and absolute discretion, that user will breach a term or condition of these TOS, History Imprint may cancel such transactions and restrict access.

History Imprint at any time without any prior notice may change terms and conditions and will occur no liability for doing so.

Representation and Warranties

Users of the site represent and warrant to History Imprint that in use of the Historyimprint.net site, user will not infringe the copyright, trademark, patent, trade secret, right of privacy, right of publicity or other legal right of any third party. User further represents and warrants to History Imprint that there are no claims, demands or any form of litigation pending, or to the best of user’s knowledge, threatened with respect to any of user’s content. History Imprint, will not be required to pay any third party related to using the content provided by the user. User content should not cause direct or indirect injury to any third party and should be free of Viruses or any other program or technology that can cause direct or indirect damage to the site.

Disclaimer and Exclusions:

History Imprint provides a website Historyimprint.net service on an “as is” and “as available” basis. History Imprint, do not represent or warrant that site will be uninterrupted, will be free of errors and in accuracies, will be reliable, will be timely, and will meet user’s requirements. History Imprint makes no warranties other than those made expressly in these TOS, and hereby disclaims any and all implied warranties, including without limitation, warranties of fitness for a particular purpose, merchantability and non- infringement.

History Imprint will not be liable to any user or any third party for any consequential, incidental, indirect, punitive or special damages (including damages relating to lost profits, lost data or loss of goodwill). Arising out of relating to or connected with (a) the use of the site or any service or products based on any cause of action, even if advised of the possibility of such damages. (b) the content contained on the site, or (c) any delay or failure in performance beyond control of the Covered Party.

Limitation of Liability.

Limitation of liability, under for a breach of a party’s representations and warranties under these TOS or in connection with your indemnity obligations under these TOS, in no event will the liability of History Imprint exceed the value of the prints ordered or serviced rendered. Value of the prints or services are limited to the stated value on the History Imprint site or charged to the customer.

Indemnification

User must indemnify and hold History Imprint and its employees, partners, suppliers, representatives, agents, affiliates, directors, officers, managers and shareholders (if applicable) harmless from any damage, loss, or expenses including reasonable attorney’s fees incurred in connection with any third-party claim ,demand or action brought against any of the parties alleging that user have breached any of these TOS through any act of omission.

Registration

User might be asked to register at the site. User must agree to provide accurate, complete registration information. Each registration is for personal use only and access to that information should not be made available to multiple users.

Colour issues

History Imprint uses standard industry software for designing and printing purpose. We do not guarantee any colour matching or exact colour print. Slight colour variations are possible and should be considered as acceptable and will not be considered production mistake and will not be eligible for refund or return or re production. We use best judgment to match colour.

Production:

History Imprint uses production facilities inside Australia.

Design Proofing:

History Imprint will do its best to check any design made by user. But will not be held accountable for any of the users mistakes in choice of text or colour in design of prints ordered. Please double check all your design before submitting order. History Imprint can not be held responsible for mistakes in design made by the customer.

Delays:

History Imprint shows estimated delivery date based on average shipping times, they are an estimation. History Imprint can not be held responsible for deliveries arriving outside due estimation date.

Refund and Returns:

History Imprint will not allow any refunds unless there is error on History Imprint. Refund value will be less or equal to the sold price of the product excluding shipping charges. All refunds have to be approved by the Customer Service Person. Refunds are issued within 15 business days from its approval. History Imprint will not be responsible for any charges by the bank or third party including but not limited to Fees or interests. Our main priority is your satisfaction, we try and take maximum care that our products are free of manufacturing defects, but if you do feel something is not right with your order please contact us within 30 days of receiving the order and we will make sure to assess and send out a refund or a replacement if the claim is found genuine.

Our Return Policy:

If the product fails or breaks due to a manufacturing defect during that time, you agree to take a photograph of the failed or broken product and send the photograph or the original failed or broken product to History Imprint. Upon receipt of the product or the photograph, History Imprint will send a replacement of the product or will issue History Imprint credit for the purchase value of the failed or broken product(s) In a case , the customer does not want store credit , refund will be issued for the order.

History Imprint does not guarantee or warrant that its products will work for any intended purpose or in any set of conditions. You agree that the determination of whether a products failure or breakage is due to a manufacturing defect is within the sole discretion of History Imprint. You further agree to provide full and complete information regarding the circumstances of the failure or breakage, including but not limited to the use of the product, the conditions the product was in, and any other information useful to an informed determination by History Imprint as to the cause of the failure or breakage.

Miscellaneous:

These TOS will be binding upon each party hereto.

Dispute resolution:

In the rare event of dispute, all disputes arising out of, relating to or connected with these TOS or your use of any part of the history imprint.net service will be exclusively resolved under confidential binding arbitration in accordance with the commercial arbitration rules of JAMS. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. Judgment on arbitration award may be entered in to any court having jurisdiction thereof. History Imprint may seek equitable relief, including, without limitation, injunctive relief and specific performance without the requirement of posting a bond or other security or proving damages are insufficient, from a court of competent jurisdiction. We further add that the first step of dispute resolution will be although not limited to making personal contact with History Imprint. david@historyimprint.net

General Statement of Principles

As described in detail below, any information we gather at this web site is strictly for our use and is not shared with any other entity, public or private, for any reason - period. We will not sell or give away any lists or other data that we may retain and we do not purchase such information from other sources.

Statistical Data

Our servers (as most) track IP addresses and referring pages to help with site maintenance and improvements. This data is viewed only as anonymous statistics to show the busiest times of the day or week, pages with errors and how effective our advertising has been. This information is not used for any other purpose.

Personal Information Collected - Order Forms

With the exception of credit card info, we store the information from your order form to allow us to track consulting issues or refer to a previous order to help provide some customer service. You may elect to have your information completely removed from this system by e-mailing us at david@historyimprint.net with your request. We do not store any type of sales information.

Information Correction or Removal

If you wish to correct, update or remove any information about you that may be in our records, please send us e-mail with the details of your request.

Cookies are files with small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and stored on your computer's hard drive. We use "cookies" to store your cart contents for you. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use the checkout section of our site.

Changes To This Privacy Policy

This Privacy Policy is effective as of August 15 2018 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.
